TERMS AND CONDITIONS
§ 1 Provider and Scope
(1) The provider of this online shop is Katharina Fuchs, operating under the name “vintageBambi”, with address and contact details as stated in the Imprint.
(2) These Terms and Conditions apply to all contracts concluded between Katharina Fuchs (hereinafter referred to as “vintageBambi”) and its customers via the online shop.
(3) Customers within the meaning of these Terms and Conditions may be consumers or businesses.
(4) A consumer is any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business, or profession.
(5) Any conflicting terms and conditions of the customer shall not apply unless expressly agreed to in writing.
§ 2 Conclusion of Contract
(1) The presentation of products in the online shop does not constitute a legally binding offer but rather an invitation to place an order.
(2) By completing the ordering process and clicking the “Buy” button, the customer submits a binding offer to enter into a purchase contract.
(3) The contract is concluded when vintageBambi confirms the order by email or provides the ordered goods or digital content.
(4) Before submitting an order, customers may review their information and correct any input errors at any time.
(5) The contract text will be stored after conclusion of the contract and provided to the customer by email as part of the order process.
(6) The contract language is German.
§ 3 Prices and Payment Terms
(1) The prices displayed in the online shop at the time of ordering shall apply.
(2) All prices are final prices and include applicable statutory VAT where required.
(3) Available payment methods are displayed during the checkout process.
(4) Deliveries outside the European Union may be subject to additional customs duties, taxes, or fees, which are the responsibility of the customer.
§ 4 Delivery and Provision
(1) Physical products will be shipped to the delivery address specified by the customer.
(2) Information regarding delivery times can be found on the respective product pages.
(3) Digital products will be provided electronically after successful completion of the order. Delivery is made via a download link on the order confirmation page and/or by email.
(4) The customer is responsible for providing a valid email address and ensuring that emails from vintageBambi can be received.
§ 5 Right of Withdrawal
(1) Consumers are generally entitled to a statutory right of withdrawal.
(2) Details regarding the right of withdrawal can be found in the separate Cancellation Policy.
(3) For contracts relating to digital content, the right of withdrawal may expire prematurely in accordance with applicable law if the customer has expressly agreed that performance of the contract begins before the withdrawal period expires and has acknowledged that this results in the loss of the right of withdrawal.
§ 6 Usage Rights for Digital Sewing Patterns and Digital Content
(1) Upon purchase of a digital sewing pattern, sewing instruction, or other digital content, the customer receives a non-exclusive, non-transferable license for personal use only.
(2) All digital content offered is protected by copyright.
(3) The sharing, reproduction, publication, distribution, or resale of the files or parts thereof is prohibited without the express written permission of vintageBambi.
(4) Digital files may only be used for private purposes.
(5) The sale of garments or other products made using the sewing patterns is not permitted without a separate commercial license.
(6) A separate commercial license may be purchased for commercial use. Interested parties may contact vintageBambi directly for further information.
(7) The publication of files or parts thereof on websites, social media platforms, cloud services, download platforms, or similar media is prohibited.
(8) Transfer of usage rights to third parties is not permitted.
§ 7 Copyright
(1) All sewing patterns, instructions, texts, images, graphics, and other content offered in the online shop are protected by copyright.
(2) The purchase of a product does not transfer any copyright ownership.
(3) All rights remain with Katharina Fuchs or the respective rights holder.
§ 8 Warranty
The statutory provisions regarding liability for defects shall apply.
§ 9 Dispute Resolution
(1) The European Commission provides a platform for online dispute resolution.
(2) vintageBambi is neither obligated nor willing to participate in dispute resolution proceedings before a consumer arbitration board.
§ 10 Applicable Law
(1) The laws of the Federal Republic of Germany shall apply, excluding the United Nations Convention on Contracts for the International Sale of Goods (CISG).
(2) For consumers, this choice of law shall apply only to the extent that mandatory provisions of the law of the country in which the consumer has their habitual residence are not deprived of their effect.
§ 11 Final Provisions
Should any provision of these Terms and Conditions be or become invalid or unenforceable in whole or in part, the validity of the remaining provisions shall remain unaffected.
